Аннотация:
The article discusses the issue of applying paragraph 3 of Art. 1109 of the Civil Code
of the Russian Federation, namely, is it possible to claim enrichment under one of the conditions which are specified in this legal rule - either bad faith on the part of the recipient, or a counting error, or a combination of them is needed. Based on the analysis of judicial practice, it was concluded that the text of the norm contains editorial inaccuracy and that any of the conditions specified in it is sufficient to recover the overpaid amounts.
